Same sex marriage laws in New York

This past year New York State became the last of the states to legalize same sex marriage. Within hours after passage virtually every Long Island attorneys added same sex marriage to their websites as a new area of practice. One would have to wonder what would be the point of divorce attorneys jumping on the bandwagon so soon, after all, it’s hardly enough time to have a bad marriage. However, the issue at this point is not divorce or prenuptual but about the more complex issue of property after marriage. Our researchers called several Long Island attorneys to get a better understanding of the issues. In brief the dilema lies in the fact that many same sex couples who have been together for several years are likely to own properties together. Now the question exists as to the status of that property after a marriage and a potential divorce. Although the law was met with enthusiasm by members of the gay and lesbian communities, Long Island Attorneys and elsewhere in the state have a great deal to contend with.
